1. Acceptance of Terms & Minimum Age Requirement (13+ / 18+)

By accessing, uploading photos, or using FaceSwapperAI.com, you certify that you meet our minimum age thresholds, possess legal capacity to enter this agreement, and agree to be bound by these Terms and our Privacy Policy.

Binding Agreement & Legal Capacity

These Terms of Service constitute a legally binding agreement between you ('User' or 'You') and FaceSwapperAI.com ('FaceSwapper', 'we', 'us', or 'our'). If you do not agree to these terms or do not meet the minimum age requirements, you must immediately cease all access, upload attempts, and use of the platform.

Strict 13+ Minimum Age (COPPA Compliance)

You must be at least 13 years of age to access or use FaceSwapperAI.com. Pursuant to the Children's Online Privacy Protection Act (COPPA) and international child data protection principles, FaceSwapper does not knowingly solicit, collect, or process facial biometric identifiers or personal data from children under 13. If we discover that an individual under 13 has uploaded photos or accessed the service, all associated session data and ephemeral files will be immediately purged.

Jurisdictional Digital Consent (16+ EEA / UK)

If you reside in the European Economic Area (EEA), United Kingdom, or any jurisdiction where the statutory age for digital consent under GDPR Article 8 or the UK Data Protection Act is higher than 13 (such as 14, 15, or 16), you must meet that jurisdiction's minimum threshold or have verified authorization from a parent or legal guardian.

18+ Threshold for Mature Content, Legal Indemnity & Third-Party Permissions

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to: (1) agree to the legally binding indemnification obligations under Section 3; (2) upload or grant consent for the likeness of another person; or (3) generate face swaps in adult, stylized, or sensitive contexts. Minors are strictly prohibited from generating, uploading, or appearing in any sexually suggestive or mature synthetic transformations.

Parental & Guardian Supervision & Liability

If you are between 13 (or your local age of digital consent) and 18, you may only access FaceSwapper with the express review, consent, and active supervision of your parent or legal guardian. Parents and guardians who allow their minors to access the platform assume full legal responsibility and liability for the minor's usage, photo uploads, and compliance with these Terms.

Service Nature & Intended Use

FaceSwapper is an automated web studio providing transient neural network transformations to replace faces across user-supplied photos. It is provided strictly for lawful personal, creative, and satirical expression.

2. Zero Tolerance: CSAM & Non-Consensual Imagery (NCII)

We enforce an absolute zero-tolerance policy against unlawful, non-consensual, and abusive media. Violations will result in immediate bans and referral to global authorities.

Child Sexual Abuse Material (CSAM / CSAE)

The generation, uploading, transmission, or facilitation of Child Sexual Abuse Material (CSAM), Child Sexual Exploitation and Abuse (CSAE), or any sexualized imagery depicting or appearing to depict minors is categorically prohibited. Any detected or suspected violation results in an immediate permanent ban, IP blocking, log preservation, and automatic mandatory reporting to the National Center for Missing & Exploited Children (NCMEC) pursuant to 18 U.S.C. § 2258A and relevant international law enforcement agencies.

Non-Consensual Sexual & Intimate Imagery (NCII)

You are strictly prohibited from generating, rendering, or uploading synthetic intimate imagery, sexually explicit media, non-consensual deepfakes, or 'deepnude' modifications of any individual without that individual's explicit, advance, and verifiable written consent. We actively support federal and state protections against digital forgery and intimate privacy violations.

Defamation, Fraud & Malicious Impersonation

You may not use FaceSwapper to deceive, defraud, blackmail, harass, or defame any individual, or to interfere with public elections or judicial proceedings. You must never generate misleading synthetic media intended to falsely represent a real person endorsing products or committing illicit acts without their permission.

AI Safety & Global Compliance

In alignment with Article 50 of the European Union AI Act and global synthetic media safety standards, you acknowledge that generated outputs are artificial and agree never to misrepresent AI-generated face swaps as authentic unaltered photographic records.

3. Likeness Rights, Biometric Consent & User Indemnification

You are solely and strictly responsible for the images you upload and the individuals whose faces you choose to modify.

User Likeness Representations & Warranties

You expressly represent, warrant, and covenant that you possess all legal rights, permissions, and affirmative, informed consent from every living or deceased person whose photograph, facial geometry, portrait, or likeness is uploaded or edited on the platform. If you are uploading a photograph of a minor, you represent and warrant that you are their parent or legal guardian with authority to consent on their behalf.

Biometric Data Processing

By initiating a face swap, you affirmatively grant your express written consent to the transient extraction and processing of facial landmarks strictly to execute the swap, governed by our Biometric Information Privacy Notice.

Comprehensive User Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS FACESWAPPERAI.COM, ITS OWNERS, OPERATORS, AFFILIATES, CONTRACTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, JUDGMENTS, PENALTIES, COSTS, AND REASONABLE LEGAL FEES (INCLUDING ATTORNEY'S FEES) ARISING FROM OR RELATED TO: (A) ANY CLAIM THAT AN UPLOADED IMAGE OR GENERATED FACE SWAP INFRINGES OR MISAPPROPRIATES ANY THIRD PARTY'S RIGHT OF PUBLICITY, PRIVACY, DEFAMATION, MORAL RIGHTS, TRADEMARK, OR COPYRIGHT; (B) ANY CLAIM ASSERTING UNLAWFUL COLLECTION OR USE OF BIOMETRIC DATA OR IDENTIFIERS UNDER APPLICABLE STATUTES (INCLUDING ILLINOIS BIPA 740 ILCS 14/, TEXAS CUBI TEX. BUS. & COM. CODE § 503.001, WASHINGTON RCW 19.375, AND GDPR ART. 9); OR (C) YOUR VIOLATION OF THESE TERMS OR APPLICABLE LAW.

4. Ownership, Temporary License & Zero Permanent Retention

You maintain full ownership of your photos. We do not sell or permanently store your personal media.

Content Ownership

You retain whatever preexisting ownership, copyright, and intellectual property rights you hold in the photographs you submit to the service.

Limited Processing License

You grant FaceSwapper a strictly temporary, revocable, non-exclusive, worldwide, royalty-free license to host, resize, cache, analyze facial vectors, and process your uploaded assets solely and exclusively for the technical purpose of executing the requested face swap and returning the render to your browser session.

Zero Permanent Retention

Uploaded source images, target images, generated outputs, and ephemeral facial landmarks are processed in transient memory and automatically purged from our computing infrastructure immediately after rendering is complete. We do not use your personal uploaded photographs to train foundational artificial intelligence models.

5. DMCA Copyright & Unauthorized Likeness Takedown Policy

We respect intellectual property and personal rights. Below is our formal statutory notice procedure under the Digital Millennium Copyright Act (17 U.S.C. § 512) and our expedited likeness removal process.

DMCA Notice Requirements (17 U.S.C. § 512(c)(3))

To submit a legally valid DMCA copyright takedown notification, please provide our Designated Agent with the following written information:

Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
Identification of the material claimed to be infringing, with sufficient information (such as specific URL or screenshot) to permit us to locate the material.
Your contact information, including your full legal name, physical address, telephone number, and email address.
A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Fast-Track Likeness / Non-Consensual Depiction Removal

If you believe your personal face, portrait, or likeness has been uploaded or displayed anywhere on our website without your authorization, submit a removal request containing: (1) your full name; (2) identification and URL/location of the image; and (3) reasonable proof of identity. Upon receipt of a verifiable likeness takedown request, we will expeditiously remove or disable access to the contested material.

Counter-Notification & Repeat Infringer Policy

If you believe your content was disabled or removed by mistake or misidentification, you may submit a counter-notification complying with 17 U.S.C. § 512(g). In accordance with Section 512(i) of the DMCA and applicable laws, FaceSwapper maintains a strict policy of terminating access and blocking IP addresses of users determined to be repeat infringers of copyright or personal publicity rights.

6. Warranty Disclaimers & Limitation of Liability

FaceSwapper is provided on an 'as-is' and 'as-available' basis without warranties of any kind.

FACESWAPPERAI.COM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, QUALITY, SUITABILITY, OR CONTINUOUS AVAILABILITY OF THE SERVICE. AI TRANSFORMATIONS MAY PRODUCE UNPREDICTABLE OR IMPERFECT VISUAL ARTIFACTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL FACESWAPPERAI.COM, ITS OPERATORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS REPUTATION RESULTING FROM (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE; (B) ANY USER CONTENT OR CONDUCT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS OR ALTERATION OF YOUR CONTENT.

Severability & Integration

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of any remaining provisions.
